While the scale of the problems is intimidating, perhaps that of the solution is not, specially when it comes to the question pertaining to our individual role in the society. All we have to do is to find out those little things which can be fixed and fix them. </p> <p align="justify">Sounds lucid or baffling? Here is an example, we all will agree that one of the biggest obstacles in the path of human development is human ignorance or more fundamentally in case of our country – illiteracy. The problem is really big, to educate around 20 crore more Indians…solution is really simple, teach one illiterate, how to read or if that seems too burdensome, support unprivileged children in your neighbourhood. The support could be as simple as providing books or pencils. We must not seek any fame in that, if we want real satisfaction from that work.</p> <p align="justify">What is it that holds us from doing anything despite our sinusoidal emotions for our nation? <strong><em>The indifferences we have created within ourselves are so profound that no external stimulus seem to evoke any response from us</em></strong>. How to fight this state of frustrating inactivity? A state where we watch prime time news as a prime time show. <strong>The key is in realizing that we are responsible for whatever happens in our society</strong>, even if it is not related to us remotely in a conspicuous manner. Owning responsibility for each and everything will be emotionally torturous in the starting, but soon it brings a change in our thinking when we begin to think how something could be stopped and also start acting in that direction. </p> <p align="justify">Take an example, you see a plastic wrapper on an otherwise clean Metro platform, you may curse the unknown sinner who threw it earlier or may just pick it up and throw it in a dustbin. Even if the dustbin is located outside the metro station, carry it along with you and throw it there. Your action might not immediately change the hearts of onlookers, compelling them to accompany in your noble efforts, but they will definitely take a note of it and one day they will be part of your self purification movement. Inspire people more by your deeds and less by preaching. <strong><em>When a rich and well to do lawyer can replace his expensive clothes with a homespun lungi and can shake the conscience of entire world, we have much less to sacrifice and much less to change. </em></strong></p> <p align="justify"><em>What is that must be change to make this world a better place? </em>Today individual, society, nation and the world, all exist in a delicate interdependent ecosystem, change in one leads to change in other. So we need to change ourselves, our perception to the surroundings, the change is required in our belief that two wrongs make it right, they don’t. Change is required to make us believe that we have to speak up for at least ourselves if not for others, even if it is as a simple problem as enforcing a no smoking regulation in a village bus. Change is required in seeing ourselves a part of problem and hence solution. Change is required in our vision of society and our nation, because our future vision is the present of our progeny. We must change the system we are going to bequeath upon our children. Let millions of us perish in that endless pursuit of a prosperous society, even if we can’t build a society of our dreams in our lifetime, we shall contribute at least a brick to that. Let us contribute our own tone to this symphony of change, that will mellifluously echo in the minds and hearts of our brethren. All of them were related to corruption in some or other manner. The judgements passed were expected to leave a historical impact on the way Corporates, Politicians, Governments and ‘Aam Aadmi’ work in this country. There were similar things on in the neighbourhood as well as in Western World, we’ll take a look on the events taking place there also. </p> <p align="justify">The SC has lately started sounding ambivalent in its decision, some sort of finding always the mid way. It has also formed a love-hate relationship with the government, criticizing it at one time and conforming to its policies at the other. Lets take all the cases one by one and the mid path position taken by SC to make ‘justice seemed to be done’ while at the same time absolving the guilty.</p> <p align="justify"> First, the 2G case, the biggest scandal in the history of Independent India. SC while cancelled all the licenses issued there with. It absolved PM of any delinquency. The reason given was that PMO did not apprise him of the full facts and so he can’t be held guilty in the case. Sounds funny, bureaucracy in this country is not so powerful that could keep PM in dark. Moreover what happened with the principle of ministerial accountability and collective responsibility, the arch stones of a Parliamentary Governance? A mid way position where you tell the corporate that it could not go this way, but absolving the government of any guilt.</p> <p align="justify">Second, Army Chief’s Age Raw – it got to be somebody’s mistake? There is a clear cut scenario where the date was not corrected even after several requests by the Chief and later his acceptance of the date as such ‘under pressure’ and the subsequent denials. Either you punish the record keeping agency and ask it to get its act together or you tell the Chief why so late? Again, a midway, where you condemn both, and appreciate the latter for his bravery, which anyone would, since he is Army Chief and no one has doubts regarding his integrity. What precedent are you setting for less fortunate people, when a powerful person like Army Chief had to fight so much for such a simple thing?</p> <p align="justify">Third, the Vodafone case, SC held that Vodafone wasn’t liable to pay taxes for the transfer deal, since the subsidiary was located in Mauritius. A boon for all those companies who are evading tax laws of a country by locating subsidiaries in tax heavens. One of the reasons given was the investment climate of the country should be favourable. Then why did you cancel the 2G licences at all, we would have accepted that also as a fait accompli. And did you forget your own judgement in Salwa Judam case, where you dedicated a good part of your judgement in denouncing the neo-liberal policies of the government? I am not an expert in the legal matters, but a simple reading of the IT Act, mentions that the tax will be levied if the capital is located in the country, which I guess, is located.</p> <p align="justify">Fourth, Ramdev case – it was a shear violation of fundamental rights of the public to protest peacefully. Good, an eloquent judgment was written, mentioning the sleep also as a fundamental right. But Ramdev was also held complicit saying he did not follow the orders of vacating the round. If I am not mistaken, they were protesting there, not performing a rock concert. Is government authorized to suppress any protest just by ordering that place of the protest be vacated? </p> <p align="justify">And about the illegal occupation of the ground, since method of protest was Gandhian, lets compare it to ‘his’ tactics. When he appeared on the Freedom Struggle scene, he broke all sorts of the law, but he never broke the fundamental law of peace. It was he, who started a new phase in the methods of protest by Congress, while Congress used to abide by the law at the time of protests earlier, it was he who brought idea of Non-Cooperation on the forefront. He used to keep long fasts, he must had been held guilty of ‘attempt to suicide’ in that case. I believe the in this case, there should have been some strict exemplary punishment for the government. As of now, all of you have done is to make them pay compensation, that too using public money.</p> <p align="justify">Now the neighbourhood, Pakistan. The judiciary almost caused a judicial coup there by maintaining a stand that government must reopen cases of President Zardari in swiss courts. And since the government did not comply, prosecution for holding PM, not the PMO, guilty of Contempt Charges started. NO midway was taken. The easy way for the court could have been to criticize the government for its omission and leave the case pending till President dies or gets 98 year old(recently an ex-minister was held guilty at this age in India).</p> <p align="justify">Germany, President had to resign facing the <em>prospect </em>of prosecution for allegations of corruption relating to his prior service as Prime Minister of Lower Saxony. And now compare that with India, he resigned merely on the ‘prospects’ of prosecution, in our country, they try to stay unless the conviction happens.</p> <p align="justify">Indian Judiciary has helped maintaining the ‘Rule of Law’ in the country throughout its entire history. Today also, it makes us feel proud when through various instruments of law, it tries to maintain public confidence in the law. They can be made aware of their responsibilities towards the society and individual and collective capabilities of how a transformation in the society could be brought at personal and local level.</strong></em></p></blockquote> <p align="justify">The recent ‘awakening’ of the nation was no less than a miracle. At one point of time it seemed difficult that Indians, could come together for one issue, rising above their self interests, and taking out some time from their highly busy and ‘productive’ life. But it happened and it happened magnificently. ‘The People’ behaved very responsibly following all principles of a peaceful revolution while asserting their demands forcefully.</p> <p align="justify">The basic fact that everyone understands is we just need a reform of the system, the demands are legitimate and in no way anyone is asking for a overthrow of the state and an establishment of alternative order. Comparing to the freedom struggle of India this is very much similar to the Swadeshi Andolan of post 1905 Bengal Division, when people demanded for nothing else but reunification of Bengal. </p> <p align="justify">The Swadeshi Andolan was a watershed in the history of India, before that <img style="margin: 10px 0px 0px 10px; display: inline; float: right" align="right" src="http://images.smh.com.au/2011/08/28/2587424/ipad-art-wide-anna-420x0.jpg" width="224" height="164">Moderates were working through the instruments of petitions, resolutions and pleadings. They were also able to get some piecemeal but substantial reforms in the governance. This could be equated with the RTI and NREGA of our times, which were achieved through same ‘constitutional’ means of lobbying and pleading.</p> <p align="justify">What changed in the Swadeshi Andolan was the unprecedented participation of the masses, and use of ‘extra constitutional’ means (not illegal or unconstitutional, just ‘extra’ constitutional). Same happened in the Anna movement, which is blamed to be of ‘undermining’ the parliamentary democracy but no one could say that it was unconstitutional or illegal. Assertion of one’s rights is a basic human right, no legal maxim could snatch that away.</p> <p align="justify">One more similarity with the Swadeshi Andolan is that the Moderates and the then intelligentsia were apprehensive of a mass movement and were afraid of antagonising the ruling establishment. Same could be observed today with the opposition of Aruna Roy and other Civil Society leaders as well as the legal fraternity to a mass movement of this kind.</p> <p align="justify">The other similarity is rather a painful one. Swadeshi Andolan though achieved its goal after 6 years in 1911, it fizzled out by 1908. The reason was oppressive techniques of government. The leaders were apprehended and the revolution was left leaderless. The government is trying to do the same today by playing dirty orwellian tricks. Then also a promise of a Minto Morley Reform came to pacify the movement and today also the ‘sense of the House’ has tried to do the same. Reforms came but nowhere near the expectations, and I am afraid the same is going to happen now.</p> <p align="justify">The thing is that now People’s leadership(I prefer this name rather then Team Anna, which seams like a private venture) has no other option but to wait and watch. Any more time bound persuasion is going to harm the prospects of a strong Lokpal. </p> <p align="justify">But the most important thing which People’s leadership must do is to channelize the newly released energy of the youth and the masses at large for some constructive and reformative work. Leaving it wandering in search of something to do is going to harm the prospects of a mass agitation, which I am sure will be needed in the future. </p> <p align="justify">To start with, a mass drive to encourage people to join NGOs can be initiated. They can be made aware of their responsibilities towards the society and individual and collective capabilities of how a transformation in the society could be brought at personal and local level. Most of the employed class have a five day week and the remaining two days can be used to teach unprivileged children and educating the masses about there rights. There are so many evils which exist at personal and social level like female foeticide, dowry, preference for a male child, education of girl child etc, which if removed are going to help the nation in long way.</p> <p align="justify">People can also be taught to fight for their rights at local level. Since at Panchayat or Gram sabha level, communities are more cohesive, it needs a little training of optimal use of resources and a zeal to develop into a prosperous society. The experience of Ralegan siddhi could be very useful here.</p> <p align="justify">The reforms begin from the individual level, whether its about being corrupt, tax evasion, over pricing or something else. A rational critique and argument should be made to the people, to make them understand that anywrong done to the society is a wrong done to oneself.</p> <p align="justify">The scope to reap in public for the cause of public is much wider than anyone could think of. The moment should be stolen to make it a moment to remember for the History of India.</p> <p align="justify">Remember our childhood?, when Mom used to wake us up and simultaneously used to tell us to get fresh, brush teeth, take bath and get ready for the school….almost everything every morning used to be told to us, even while it used to be the same. Men’s experiments with money loosely started from bartering during river valley civilizations and extends to the currently prevalent fiat money system. It started with a promise to solve trading problems, which barter system could not solve and has evolved into the cornerstone of modern economics, driving and determining country’s trade, economic prosperity and its relations with the world outside. This certainly imposes a necessity to think about (mis)use of this system as a weapon to fight power games while suffocating another country’s trades and simultaneously creating inflationary problems for your own people, which in long term may lead to a ‘currency bubble burst’ kind of scenario. Because historically in world economics everything that rises up so rapidly, simply crashes one day.</p> <h3 align="justify">A bit of history</h3> <p align="justify">The earlier barter system was succeeded by <em><strong>commodity money</strong> </em>in which the currency used to represent the value of the substance it is made of. So if you melt the coin, you don’t loose anything. It was followed by <strong><em>standardized money</em></strong> in which the value of currency exceeded that of the substance it was made of. The difference between the ‘real value’ of the money and the ‘market value’ kept on increasing. Then with the emergence of bills of exchange and banknotes, came the concept of ‘gold/silver’ backed currency or representative money which guaranteed that against that banknote a definite amount of gold/silver is kept in treasury, which can be redeemed by returning this banknote. <strong>This is the reason we see “I promise to pay bearer a sum of ….” statement signed by bank governor on our currencies. </strong>But soon the money became over valued, there was meagre amount of back up treasury maintained. The new thing was <strong><em>‘fiat money’</em></strong>, backed up by a sovereign guarantee and not by other commodity.</p> <h3 align="justify">Real Sector vs. Financial Sector</h3> <p align="justify">Real sector of an economy represents the aggregate demand and aggregate supply of goods and services in the economy. It has two major markets – production factor market and the output market. While financial sector represents the system which supports real sector by providing financial services like banking, insurance, investment fund etc.</p> <p align="justify">It has been found that finance sector leads the growth of real sector, which means a well developed finance sector will have a well developed economy. <strong>Adam Smith </strong>expressed the view that the high density of banks in the Scotland of his times was a crucial factor for the rapid development of the Scottish economy[<a href="http://epub.wu.ac.at/196/1/document.pdf">1</a>]. So the huge credit generation and money mobilisation by financial sector leads to the increased demand and supply in economy and hence to the real sector growth. This makes it a strong case for legitimised <strong>‘<em>offshore banking</em>’ </strong>with all its socio-economic evils. </p> <p align="justify"> </p> <h3 align="justify">Why do governments print so much of money and who regulates it?</h3> <p align="justify">We were amazed at the US declaration in 2008 to provide a USD 2.3 trillion economic stimulus with a ‘plan’ that out of that USD 1 trillion will be printed. the immediate question which came to mind was how? Is this just the sweet will of government to print the money and won’t it create the global and national intersectoral imbalances? The answer was actually given by US Treasury Secretary John Connally (after US moved away from gold backed currency) – “<strong>This is our currency and your problem</strong>”.</p> <p align="justify">Not going into much details basically the developed countries print excessive amount of money to keep their imports of raw material cheaper while the developing countries want to keep their exports of ready material cheaper in the international market. Main aim is to keep the currency undervalued. And both north and south are sort of in competition and trapped in a vicious cycle to print more and more of money causing huge fiscal deficits and ultimately PIIGS type of situation.</p> <p align="justify">Another reason is to create demand in the economy by supplying money. Take example of welfare schemes like NREGA, the money given is without creation of productive assets and is with very meagre returns of investment. This way developing countries try to stimulate growth. Developed countries resorts to this in times of crisis.</p> <p align="justify">The money increase also inflates GDP growth figures, showing a perceived growth of economy. </p> <p align="justify">Also when country’s foreign trade increases, it needs to print more of domestic currency to ‘manage’ the incoming foreign currencies.</p> <p align="justify"> </p> <h3 align="justify">They all seem to be good and desired advantages, any problems?</h3> <p align="justify">Obviously, that’s why this article is being written. The most visible problem is <strong>inflation</strong>. Because of supply demand mismatch of money the value of currency decreases and it leads to inflation with all its side effects. More you ‘manipulate’, more the poor people pay. So all people who are jealous of China, for its manipulative power can feel pity for her poor. Paul Krugman says about Chinese case that while an undervalued yuan helps the industrialist community, it is detrimental to the interests of poor. </p> <p align="justify">In absence of balancing by market of goods and services, this printed money creates ‘<strong>false assets’</strong> in the economy, mostly in terms of high real estate prices having a dead underlying asset.</p> <p align="justify">The other problem is unhealthy practices like the current Currency War. A nation will try all measures to keep its currency undervalued and print more currency in absence of any international guideline controlling printing of money.</p> <p align="justify"><em><strong>This is an ever expanding phenomenon, soon there will be a time when Rs 100 notes will also be phased out because of their unviability as it happened recently with 50 paisa coin. We may imagine a global future where fiscal deficits of governments will be too high and so will be the tax rates, there will be no more chances of increase in the ‘real assets’ which are limited by nature’s limits to produce. Where more and more money will be generated but there will not be any takers for that, as fundamental system of economics is bootstrapped by availability of raw materials which can not be created beyond a limit. Globally and historically the “Stock Price bubble” has busted, the “real estate bubble” has busted, and the “Gold Bubble” is just waiting to be. On national level we have seen many countries going bankrupt e.g. PIIGS in recent times and may Afro-Asian countries in 90’s (including India), because of huge currency manipulation regimes along with their elephant size fiscal deficits. The boom-burst cycle is now believed to exist empirically.</strong></em></p> <p align="justify">Just think if the currency bubble ‘bursts’ and all legal-tenders(currencies) become completely (or almost) illegal and invalid or useless, would we back to Barter system? This may not happen in next 100 years but its bound to come. The time may be prolonged or US and China may lead a shortcut to the crisis. The political phantasmagoria which used to be entertaining once upon a time has become source of infusing pessimism in the common man. People have just left any hopes of a society based on morals and ethics, sometimes wondering whether anyone actually wants a corruption free society because we have been beneficiary of it in some or other way at any point of time in our lives. The sleazy ways have been legitimised. Morality and conscience have taken a plunge.</p> <p align="justify">The most astonishing thing among all the things going wrong on political front is the image our PM has in our hearts, All of us have a high respect for him regarding his integrity and commitment to the development of nation. Notwithstanding the character assassination by opposition and many others, we love to believe that man is true to his soul and is devoted to cause of progress of that country. For what now most of middle class reaps are the fruits of well thought reform plans launched by him.</p> <p align="justify">But among all this feel good factor about our PM, one may raise a question whether dereliction of duty does not amount to a bad character, for whatever the reasons are. During his time, we have seen many parallel independent PMs in the country. Almost all the cabinet ministers and regional party chiefs act as if they are not controlled by anyone. They are running their own fiefdoms at the expense of the national interests. The collective responsibility of the government has gone for a toss and in an unprecedented event the PM is showing his helplessness that he tried but could not pursue the respective minister to do the right thing.</p> <p align="justify">He speaks very little, and often enters the scene when much of the destruction has been done. He spoke in Kashmir 2010 problem when many valuable lives were lost already. He proposed to come before PAC when the whole winter session of Parliament was wasted. It seems like all the interested people speculate when MMS is going to make a statement. Same happened in CWG preparations. It seems that his appearance is properly scripted to gain the maximum mileage out of a situation. <strong>In earlier situations PM used to defend his colleagues but now situation has reversed as we can see whole of Congress party running to prove that he is a man of impeccable integrity. And everyone applauds when he makes his statement confirming that whatever said about him by fellow partymen is true.</strong></p> <p align="justify">Few people say that his main emphasis is on economic development of the country. He wants to avoid controversies around him and focus on how country can be put on a high growth path. But economics, development, politics and governance can never be divorced. <strong>Taking an example from Russia, </strong>after the fall of USSR, till 2000 the Russian economy was in shambles. Then came Putin and Russia saw her fortunes turning. After the 8 years of Putin-era, the economy was in good position standing upon the gains of oil boom in these 8 years, along with a very good ForEx reserve and a firm re-entry on the international political forum <em>inter alia. </em>But Russia is also struggling with problems of Nihilism, a highly corrupt judiciary, the over dependence of economy on oil and other social problems. This was a direct result of a high economic growth which did not take the social development along with it.</p> <p align="justify">In the movie “The unbearable lightness of being”, Terreza tells Tomas, “Life is so heavy for me and its so light for you, I feel as if I am a burden on you. I can’t bear the this lightness of yours, I am dying under the weight of your lightness.” This is what we have to say to you Mr PM, we can no more tolerate deaths in Kashmir, farm suicides, the failed diplomatic attempts in international politics, continuing scams, rotten food grains, hunger deaths, and a dismal and despairing situation in almost every field. <em><strong>Please don’t try to convince us as if India is going on a fairy tale growth path, show us the reality, the weight of reality shall be far more bearable than the lightness of complacency. The journalism became ‘participative’, an element it always cries for in the governance. The WikiLeaks was launched like any other wiki site, editable by all, irrespective of his technical knowledge but with a rather catchy slogan – “<em>We open Governments”</em> . Later on it moved to a non-wiki framework. It shot to fame with release of documents about Iraq War and recently with the leaks of about quarter a million US embassy cables. The revealing of dirty diplomacy played by USA has once again raised the issues of ethics in foreign policy.</div> <div align="justify">Let us look into this issue. Wikipedia defines foreign policy as the strategies chosen by state to safeguard its national interests and achieve its national goals in international relations. Undoubtedly the paramount goal here is “national interest” and in the modern times state might need to engage with non-state actors to secure the national interests.</div> <div align="justify">We hardly see any example of an ethical foreign policy in the world history except what India pursued during the Nehruvian times. India had to face the severe results in form of two wars and worsening economic situation. Nehru himself confessed his failure in Parliament when he said that we had been living in a hypothetical world, which is cruel and wont let you live peacefully. Soon India moved to a more pragmatic foreign policy under Indira Gandhi and it reached its crescendo under Manmohan government when the decisions are not made based on the morality rather the benefits it promises to achieve for the country. </div> <div align="justify">So the history teaches us that a foreign policy can never be run on ethical lines, neither it can be put to public scrutiny regularly, nor I think its desired. The other name of Foreign Policy – Diplomacy has a fundamental requirement of secrecy. <em>Never let anyone know what are you thinking</em>. The governments need to make tough negotiations to achieve the end goal of national interests. Its a complex matrix and a layman can discuss it over a cup of tea but can hardly appreciate its countless dimensions. Does anyone has an explanation of why India – the largest democracy hosted a visit for a neighbourhood dictator? The only explanation is that we could not have let China eaten the Burmese fruit alone in the South Asian Eden garden, so we also ate it and fell through heaven of democracy to recognise a military government.</div> <div align="justify">So what if USA sends authoritarian messages to other sovereign governments or spies upon political leaders in other nations or negotiate with non-state actors including terrorists, we can’t pretend as if we didn’t know this happens in dark echelons of world politics. How otherwise USA would have had succeeded in getting India NSG and IAEA waivers? Certainly other nations would have demanded some favours in return and certainly India will return some favours.</div> <div align="justify">Kudos to Mr Asange, for ‘opening the governments’ and secure the people’s right to know. But we have to also see its repercussions. Most of the confidential matter is confidential only for 20-30 years, after which public comes to know about it as a fait accompli. Opening up such things while they are still being discussed will definitely obstruct the progress of the dealings. For example, the recently released cables tell about negotiations regarding US-Russia secret peace deal. That was certainly in world’s favour but now things will change as both the governments face some hardliner challenges in their own country. Republicans are never happy about any US-Russia peace deal and certainly will not let Democrats go ahead with it.</div> <div align="justify">The other aspect of a “Secret Foreign Policy” is the <strong>intent behind ‘secrecy’</strong>. If the government is doing it to preserve the interests of its nation, its well and good. This type of secrecy is followed in most of the countries including USA and India. But if the government is doing it to preserve its own interests irrespective of its people, then its too bad. This type of attitude can be seen in Pakistani foreign policy, where the ruling government is essentially driven by the motive of securing its position and amass huge wealth and for that it can allow a foreign country to conduct drone attacks on its civilians . Sometimes the latter element can be seen in other countries as well but that’s not the deciding factor.</div> <div align="justify">In the coming times, many nations, governments and larger than life politicians will be humiliated for what they think they were doing secretly. But it will hardly change the way the game of global politics is played. For no powerful country or government(USA, China, Iran etc) gives a damn to open revelation of something everybody already knew. While the scam thing has become a way of life for us, it still generates a feeling of disappointment deep within us, wondering what the future will be. The main problem is we don’t see a way out of this problem. knowing its almost impossible to defeat this leviathan System, which has the blood of corruption flowing in its veins.</p> <p align="justify"><strong>The questions which come to my mind are where is the start of this chain of corruption? What is the root cause – is it really the plummeting ethical standards of society or we need to find answers the Marxist way – through economics? Is this only Indian society which has been plagued by corruption or its a global phenomena, finding its genesis in modern politico-economic systems? Let us try to find out the answers to these questions.</strong></p> <p align="justify">Recently when I was sitting along with a close relative of mine who happens to be a government officer and is “reasonably corrupt”(takes only the ‘legitimised commission’ while ensuring that work is done properly), the CWG news was flashing across the channels. He said calmly, “I don’t why they are shouting so much. Look at our elections, do they think the elections can be fought without tons of black money. Every government official is forced to donate to ruling party fund, where that money will come from?”</p> <p align="justify">His remarks made me think whether Democracy is the thing where it all starts? For once the theory looks perfect, a democracy needs elections, elections are fought based upon the primordial-cum-development issues and the campaigning needs huge amount of money, money is needed for every aspect of electioneering, the allowed amount of money is far from pragmatic and hence the black money chips in. Now to recover that money, every involved entity in the election resorts to more illegal ways. Hence the chain strengthens and becomes a self serving cyclic system.</p> <p align="justify">Take the example of Karnataka government, the way Mr. Yedurappa engineered defections through ‘Operation Kamal’ to come to power, it was nothing but obvious that we’ll see such huge number of scams in the coming years.</p> <p align="justify">So apparently morality is an issue but not the central one. At the centre lies the democracy. Not that other forms of polity like autocracy and communism are free from this phenomenon, but still in those cases if the ruler wants, he can put the house in order, similar thing is not possible in a democratic setup, as to come to power in a mature democracy like India, he’ll need money and hence there are grim chances of anything going right.</p> <p align="justify">After this assertion, another doubt comes to mind that if democracy is the culprit then why democratic developed countries are not corrupt or not so corrupt as the developing ones. Well, I think corruption thrives in all these systems, as we know from their movies since the ‘Godfather’ days. The difference seems to be merely of degree. And they have passed through this phase of rapid economic growth when they faced the same problem of large scale corruptions. Now as they have high standards of living and a nearly ideal Capitalist system, corruption seems to be making least impact on their lives. Honestly, I don’t know anything about Scandinavian countries, how they maintain such high standards of life, but I believe rest of the developed countries are no different than ours.</p> <p align="justify"> </p> <p align="justify"><strong>Cool, but what should we do?</strong></p> <p align="justify">The theories are fine, but what is the solution, or it doesn’t exist at all? I hardly have the answer, the only solution I can think of is time. With the passage of time, I hope our country will attains an equitable society and then this phenomena will whittle away. Also we can expect that our next generations will get progressively more honest than we are, as I see that current generation has definitely improved over it previous one. Till then we have the system looking after itself, first to siphon out the money and then to reveal it. As far as Kashmiris are concerned, one might look at the conditions of people in PoK and their brethren on this side of border. Also everyone knows once liberated, Pakistan will undertake the region in its influence and there will be no end to miseries of the people. And what is the guarantee that Pakistan will not use this region to spread more violence and chaos in surrounding region? Pakistan’s apathy to the region can be easily understood by the fact that it sold a major part of its occupied Kashmiri territory to China and rest is already under heavy Chinese influence, waiting to be transferred. Kashmiris are better in India and its in best interest of India and Kashmiris also that they should not ask for separation. I accept the human right violation incidents but the demands must be acceptable, then only you stand any chance to get them fulfilled. </p> <p align="justify">The only solution to the problem is a responsible behaviour from local politicians and central government. The anti India sentiments must not be used for Vote bank and neither to gain unnecessary international fame. I support the right of free speech and in no way should Ms Roy be charged for sedition. But there are two aspects to every thing, one is law and other is morality. Law is there, means we would have to follow it, government cannot really charge her for sedition for her little speech, but shouldn’t Ms Roy exercise some restraint before reigniting the issue which is silently settling down, at least for the interests of millions of Kashmiris? Its a matter of conscience Ms Roy, just decide what is humanity and what are human rights.</p> <p align="justify">Her support to Naxalism is equally annoying, Naxalists are against the ‘Indian State’ and not Indian government. They hardly ever kill any politician or some powerful person(Its not that I want this to happen), only people who have to face the Naxalite problem are the people they claim to fight for. As a matter of fact almost everyone aware of constitutional institutions agrees over the fact that judiciary must exercise restrain while dealing with policy matters. This paper tries to see why judicial activism is necessary and whether it is required to impose any limits on this in an administrative setup that exist in India? <p> <h3>The history of judicial activism in India</h3> <p>The history of judicial activism in India can be traced to mid 1970s when Public Interest Litigations (PIL) found legitimacy in our judicial system, thanks to Justice P. N. Bhagwati and Justice V. R. Krishna Iyer. PILs have seen mainly three phases of the manner in which it was used. In first phase, till 1980s PILs were used as an instrument to get justice for disadvantaged sections of society. <p>The next phase of PILs is found in 1990s when PILs started to address issues related to anything and everything of public importance including environment and Right to Education. This was a decade of political uncertainty in country, so judiciary came forward to fill the gap in governance, especially in later half of the decade. <p>Come 2000 and PILs became an instrument of achieving selfish private interests. The courts were full of frivolous PILs and it became an instrument to get publicity. This was the time when everyone started talking about ‘managing’ PILs. <h3> </h3> <h3>The need of judicial activism</h3> <p>The administrative structure in India is known for its apathy towards the public concerns and mass scale corruption. These problems in bureaucracy have been traditionally attributed towards two things, lack of transparency in the decision making process and complete absence of a grievance redressal mechanism. <p>The Right to Information Act tried to address both the problems but partially. The citizens now have a right to know why some official action was taken and if officials are not ready to reveal the information, there is a grievance redressal mechanism. The question arises over how effective these tools have been. While RTI registered a phenomenal success in initial years in bringing bureaucracy on its toes, the piling number of cases and continued bureaucratic apathy poses danger of making this mechanism ineffective completely. <p>Next question is once people have the information that something wrong has happened, what to do with that? In the absence of any other mechanism they are left with nothing but judiciary to approach for. And how helpless will people feel if judiciary also says, <b>“Sorry, we cannot help you, it’s a policy matter and we don’t have a jurisdiction in that area.”</b> <p>Take the example of recent controversy over rotting food grains. In past decade, country is facing a problem of fluctuating food grain reserves. We had surplus food grain reserves in years 2003-04 and 2008-09 and deficit in 1998 and 2007. These anomalies were result of a flawed price structure policy and a malfunctioning Public Distribution System (PDS). In years of surplus, Government used some mechanism get rid of this surplus, part of which was exporting it at reduced price to international market (where it was used to feed cattle) and increase the supply in PDS. The same condition has occurred in 2009-10. <b>Now if a citizen is concerned about that why such bad decisions are made which produce a paradoxical state of surplus rotting food reserves, double digit inflation in food commodities and around 40% of starving population</b>, what he should do. Should he wait for the next election when Ruling Party will come to him to clarify its stand or he should he try to take the judicial route to pursue government to put its act together. <p>The basic problem is that nobody heeds the ‘common man’. Is there any forum on which a villager can go and ask the government that why did you choose to refurnish the road in a village from where ruling party has won instead of another much more needy village without any road but from where it lost? There is neither a system of hierarchical accountability in administration, nor a system where the administration is bound to respond to the complaints. <p>In this scenario is our Prime Minister really justified in saying that judiciary must not interfere in policy matters? Instead of clarifying the reasons which led to the rotting food grains in country, he went on to tell judiciary to mind its own business. If government really wants that judiciary must not interfere in its business, it needs to conduct its own business with more accountability and responsibility. There is an urgent need to put a system into place that makes public officials more accountable to citizens.</p> Abhishek भर सपने<p>आशाओं की धूल से समेटकर</p> <p>उठाये थे हमने </p> <p>मुठ्ठी भर सपने</p> <p>भींचकर रखा था हथेली में </p> <p>इस डर से की </p> <p>कहीं उड़ा ना ले जाये उन्हें</p> <p>जलाने वाली तपती हवा</p> <p>या बहा न ले कहीं</p> <p>मन को ठंडक देने वाली </p> <p>रिमझिम रिमझिम बारिश</p> <p>पर सपने अगर छुपा के रखो</p> <p>तो किसी मरे हुए की तस्वीर के जैसे</p> <p>दीवार पर चिपक जाते हैं</p> <p>और रात दिन टीसते रहते हैं</p> <p>मुठ्ठी एक दिन खोलनी पड़ी </p> <p>लगा किसी ने उम्मीदों की स्याही में उंगली डुबोकर </p> <p>तक़दीर की तख्ती पर लिख दिए थे सपने</p> <p>लकीरें अब भी हल्की ही थी</p> <p>हमने मिटने के डर से फिर मुठ्ठी भींच ली</p> <p>पर हम दौड चले</p> <p>उन्ही सपनो के पीछे</p> <p>जो लिखे थे हाथों की लकीरों में</p> <p>बहुत खुश थे हम दौड़ते दौड़ते </p> <p>कि अचानक ठोकर लगी</p> <p>और मुठ्ठी खुल गयी</p> <p>और तेज बारिश होने लगी</p> <p>लकीरें अब उस सफ़ेद पानी में घुल रही हैं</p> <p>हम बेबस से हो ये देख रहे हैं</p> <p>पर साहस नहीं है </p> <p>कि मुठ्ठी फिर से बंद कर लें </p> <p>और फिर से दौड़ना शुरू कर दें</p> <p>सपनों के साथ साथ ही </p> <p>बिखरे हुए से लगते हैं हम भी</p> <p>समझ नहीं आता कि खुद को समेटे</p> <p>या सपनो को</p> <p>हिम्मत नहीं होती</p> <p>फिर से ठोकर खाने की</p> <p>तो फिर दौड़ना कैसे शुरू कर
